Statement on Raja Petra and ISA
September 24, 2008

Transparency International Malaysia (TIM) deeply regrets that Raja Petra Kamarudin has been detained under the Internal Security Act (ISA) for two years .

It is very disturbing that the ISA is being used increasingly against those who freely and sincerely express honest and transparent views on improving the well being and future of Malaysia .

The Corruption Perception Index (CPI) issued by Transparency International only yesterday has shown that Malaysia has stagnated at just around the score of 5 out of a maximum of 10 points for the last 8 years. It is considered that this relatively poor performance can be partially attributed to our lack of national transparency due to some restrictive laws such as the Internal Security Act (ISA), Official Secrets Act (OSA) which are the antithesis of Transparency, Accountability and Integrity in our overall national governance.

The international and domestic perceptions of Malaysia’s transparency are being eroded by the easy and unnecessary application of the ISA that was designed to fight communist terrorists .

The repressive laws that we have now are archaic and outdated and are not relevant today to promote a progressive economy and a lively democratic society, with more Press Freedom, 50 years after Merdeka.

Transparency International- Malaysia (TI-M) therefore appeals to the government of Malaysia to:

1. Release immediately Raja Petra and other Detainees who are actually committed Transparent reformers and who the public do not regard as Terrorists and Threats to our national security ; and to

2. Review or Revise and even Revoke, all the laws that constraint the Rule of Law and our Fundamental Freedoms that undermine our Transparency, Accountability and the Integrity of our Nation.

3. Withdraw the “Show Cause Letters” against some Newspapers which have been promoting greater Debate and Transparency in our country .

The Corruption Perceptions for Malaysia can improve considerably, if the government takes urgent action to remove the reasons that in part cause the relatively mediocre CPI for Malaysia, that is, in fact , an advanced developing country, which should normally do better in the CPI.

Hari Selasa bersamaan 23 September 2008 saya telah menemui kepimpinan Pakatan Rakyat. Pertemuan bersama pimpinan PAS yang terdiri daripada Mursyidul Am, Tuan Guru Nik Abdul Aziz Nik Mat dan Presiden PAS, Tuan Guru Abdul Hadi Awang diadakan di Kota Bharu.

Mereka menegaskan komitmen mereka mengenai semangat dan matlamat Pakatan Rakyat. Manakala YAB Ketua Menteri Pulau Pinang, saudara Lim Guan Eng ketika pertemuannya dengan saya, menyatakan rasa puas hati beliau di dalam setiap perkembangan untuk memperkukuh dan memperkemaskan konsensus di kalangan parti Pakatan Rakyat serta penyokong daripada Barisan Nasional.

Kami juga membincangkan langkah seterusnya yang akan diambil oleh Pakatan Rakyat bagi membentuk sebuah kerajaan yang ternyata mencerminkan sokongan majoriti Ahli-ahli Parlimen. Keengganan Perdana Menteri Abdullah Ahmad Badawi untuk membenarkan permohonan kami agar diadakan satu Sidang Khas Parlimen membuktikan usaha Kerajaan BN pimpinan UMNO untuk mensabotaj proses demokrasi.

Sungguhpun begitu saya dan teman-teman di dalam Pakatan Rakyat tetap yakin dan percaya bahawa hasrat rakyat untuk melihat perubahan akan menjadi kenyataan. Kami akan meneruskan usaha dengan penuh hemah dan berhati-hati demi mencapai matlamat dan telah mencapai kata sepakat untuk tidak melayan sebarang provokasi mahupun pendekatan yang tidak bertanggungjawab serta membawa kepada ketidakstabilan dan ketidaktentuan buat negara. Saya tidak tahu mengenai adanya perundingan yang dilakukan antara Pakatan Rakyat dan Perdana Menteri - di mana kenyataan yang telah dibuat semalam menyarankan ruang komunikasi yang dibuka telah disalahtafsir.

Kini wujud satu krisis keyakinan terhadap kepimpinan negara di saat rakyat Malaysia mengkehendaki penyelesaian kenaikan harga barangan yang tertinggi di dalam tempoh dua dekad, peningkatan kadar pengangguran dan keyakinan pelabur yang semakin terhakis.

Tatkala Menteri Kewangan yang baru berdegar-degar menyatakan kedudukan ekonomi negara masih stabil, fakta yang ada merungkai cerita yang berbeza. Untuk tahun 2008 sahaja lebih daripada RM125 billion telah ditarik keluar oleh para pelabur yang semakin jelak dengan sebuah kerajaan yang gagal untuk melaksanakan hatta satu perubahan demi menjamin kebebasan sistem kehakiman dan meneruskan penggunaan undang-undang kuku besi seperti ISA untuk menahan rakyatnya tanpa menuruti proses perundangan.

Perubahan-perubahan ini adalah sendi kepada visi Pakatan Rakyat untuk memulihkan ekonomi, untuk mencipta pekerjaan buat rakyat Malaysia dan memacu pertumbuhan serta menarik pelaburan asing, juga untuk memastikan jaminan perlembagaan dijunjung termasuklah yang berkaitan dengan kedudukan Islam sebagai agama rasmi persekutuan, kebebasan beragama bagi penganut agama lain, kedudukan Bahasa Melayu sebagai bahasa kebangsaan tanpa menyekat kebebasan bahasa ibunda lainnya, dan juga status Raja-raja Melayu dan kedudukan istimewa orang Melayu dan bumiputra.

Anwar denies talks with PM Badawi

Pakatan Rakyat leaders are making contradicting statements regarding the much-touted plan by the opposition alliance to seize control of the federal government from Barisan Nasional.

MCPXYesterday, PKR information chief Tian Chua claimed that several meetings were held between the rival camps since the weekend to discuss the transition of power.

According to him, the talks involved a ‘middleperson’ for Pakatan Rakyat and a ‘middleperson’ for Prime Minister Abdullah Ahmad Badawi.

While Abdullah had denied this, Pakatan Rakyat supremo Anwar Ibrahim also appeared to be in the dark about the negotiations.

“I’m not aware of any negotiations taking place between Pakatan Rakyat and the prime minister - statements made yesterday suggesting that a line of communication was open were misinformed,” said the opposition leader in a statement.

Previously, Anwar said that Pakatan Rakyat would take control of the government on Sept 16 but this failed to materialise.

He then called on Abdullah to hold an emergency parliament session yesterday regarding the takeover but the latter refused.

The opposition stalwart claims that he has more than 30 Barisan Nasional MPs who are willing to defect in order for Pakatan Rakyat to form government.

However, his rivals have dismissed this as nothing more than a political gimmick.

No Hasty Actions

Meanwhile, Anwar also revealed that he met with the Pakatan Rakyat leadership from PAS in Kota Bharu and DAP in Kuala Lumpur yesterday.

He said Kelantan Mentri Besar and PAS spiritual leader Nik Aziz Nik Mat and PAS president Abdul Hadi Awang had reaffirmed their commitment to the spirit and goals of the alliance.

He added that Penang Chief Minister and DAP secretary-general Lim Guan Eng also expressed satisfaction with the progress made to strengthen and broaden the consensus among Pakatan Rakyat parties and supporters from BN.

“We also discussed the next steps that Pakatan Rakyat should take towards forming a government that reflects the support of the majority of members of Parliament.

“Abdullah’s failure to accede to our request for an emergency session of Parliament represents another attempt by the Umno-led BN government to sabotage and scuttle the democratic process,” he said.

“Nevertheless I along with my colleagues in Pakatan remain confident that the people’s desire for change shall soon be attained. We will proceed cautiously towards our goals and we agreed neither to be provoked into hasty action nor to take an irresponsible approach that would lead to instability and greater uncertainty in country.” he added.

Anwar also said there is a crisis of confidence in the current leadership of the nation at a time when Malaysians are demanding solutions for the highest increases in prices in two decades, increasing joblessness and the dramatic decline in investor confidence.

“While the newly appointed Finance Minister (Najib Abdul Razak) boasts that the country is in sound economic standing, the facts tell a different story.

“In 2008 already over RM125 billion has been withdrawn from the country by investors weary of a government that has failed to implement a single reform to ensure judicial independence and that continues to use draconian laws such as the ISA to detain its citizens without due process of law,” he added.
